1. Acceptance of Terms
By downloading or using the Pebble application ("App"), these terms will automatically apply to you. You should make sure that you read them carefully before using the App. We are offering you this App to use for your own personal use without cost, subject to your decision to purchase any premium subscription features.
2. Description of Service
Pebble is a productivity application designed to help you manage your screen time and maintain focus. It leverages Apple's HealthKit to track your physical activities (e.g., daily steps) to unlock its "Deep Focus" mode and Apple's Screen Time APIs to implement application limits.
3. Subscriptions and In-App Purchases
Pebble offers auto-renewing subscriptions ("Premium") that unlock additional functionality. By subscribing, you agree to the following terms:
- Payment will be charged to your Apple ID account upon confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off or you cancel at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
4. Health and Screen Time Functionality
Pebble is a supplementary tool to assist with personal productivity.
Deep Focus Mode
The Deep Focus feature may temporarily make it difficult or impossible to bypass app limits unless specific physical goals (e.g., steps via HealthKit) are met. By enabling this mode, you acknowledge and agree that you accept this temporary restriction on your device usage.
The App relies on third-party frameworks provided by Apple (Screen Time API/Family Controls, HealthKit). We are not responsible for any impact this has on your usage of other apps or device functionality.
5. User Responsibilities
You are responsible for keeping your phone and access to the App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone's security features and it could mean that the Pebble app won't work properly or at all.
6. Intellectual Property
All original content, features, and functionality of Pebble are the exclusive property of the developer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
7. Disclaimer of Warranties
YOUR USE OF THE APP IS AT YOUR SOLE RISK. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The developer expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of Liability
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
9. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will indicate that changes have been made by updating the "Effective Date" above.
